On October 7, 2023 Hamas attacked and killed approximately 1,200 Israelis. Since then more than 24,000 Palestinians have been killed by Israeli forces in retaliation and amongst them 6,000 children.
Article 51 of the UN Charter states when a state resorts to force to defend itself, necessity and proportionality must be met.
Necessity requires that force be used only as a last resort and only when there is a reasonable chance of success. Israel has used force throughout Palestinian territories for decades and all that it has done is to create more militants, terrorism and violence and more of the same will follow.
The principle of proportionality (Article 51) states that “even if there is a clear military target it is not possible to attack it if the expected harm to civilians or civilian property, is excessive in relation to the expected military advantage.” Proportionality requires that the force used be commensurate to the injury. I think Israel is marching to a different drumbeat and it is well aware of it.
